Electrical contractor insurance in West Virginia
Electrician Insurance Group provides electrician and electrical contractor insurance in West Virginia, quoting general liability, workers' comp, bonds and commercial auto with 12+ A-rated carriers.
West Virginia is building at mill scale: Nucor's $4 billion sheet mill near Point Pleasant drew more than 2,000 craft professionals. But a new or out-of-state electrical shop may owe the state a wage bond worth four weeks of payroll plus 15% before it starts, and the contractor license asks you to swear you've complied. Comp registration goes on that same affidavit.

West Virginia's two license layers and the affidavit behind them
West Virginia licenses the electrician and the business separately. The State Fire Marshal's Regulatory and Licensing Division licenses individual electricians and electrical inspectors under W. Va. Code 29-3B. The West Virginia Contractor Licensing Board licenses contracting businesses under W. Va. Code 30-42, with electrical contractor as one of nine classes. That chapter replaced the old 21-11, which was repealed when 2021's HB 2006 moved contractor licensing.
When the state contractor license kicks in
You need the contractor license only on jobs of $5,000 or more for residential work, or $25,000 or more for commercial work (30-42-3). An officer of the firm holds the license after passing an exam, and one person can hold it for only one business at a time. Your license number goes on ads and contracts, the license gets posted at every jobsite, and any contract at $10,000 or above needs a written agreement on terms the Board sets.
What the contractor license makes you certify
We found no liability insurance requirement in either 30-42 or 29-3B. Instead, before the license issues, you swear by affidavit that you've:
- complied with business franchise tax
- registered with the workers' comp and employment security funds
- complied with the wage bond law
The Board can demand financial assurance, such as a surety bond, cash bond or letter of credit, only as a disciplinary condition, capped at outstanding judgments, liens or corrective work (30-42-15). The Board's own rules weren't reviewed for a GL minimum, so ask before you apply.
The wage bond
Under W. Va. Code 21-5-14, a construction employer that hasn't actively worked in the state for at least a year must post a wage bond with the Commissioner of Labor before starting work. It equals four weeks of gross payroll at full capacity plus 15%, payable to the State, and it moves as payroll changes. You're exempt with five or more years in business in another state, $100,000 or more in assets, or a parent company in business five-plus years. Surety, collateral, escrow or an irrevocable letter of credit all work. Out-of-state shops that only want to bid can get a conditional bid-only license.
Electrician licenses and local rules
The Fire Marshal issues master, journeyman, temporary and specialty licenses. By statute, a journeyman has at least a year of experience and may not design; a master has at least two years and may design and supervise. The Fire Marshal's rules may require more, so check. Unlicensed helpers can assist a licensed journeyman or master, and the license must be posted on every for-hire job. Low-voltage work at 80 volts or less needs only a specialty license. PV wiring above 80 volts is regular electrical work.
Cities and counties can't add their own occupational license on top of a valid state contractor license (30-42-20). Permit applicants show that license or file an exemption affidavit.
West Virginia comp: one regular employee and you're in
The trigger is low. Any person, firm or corporation "regularly employing" someone in the state must carry comp (W. Va. Code 23-2-1), so your first full-time journeyman puts you in. The only carve-out is for casual employers: a business using three people or fewer, only now and then, and never past 10 calendar days in a quarter.
Owners can elect out for themselves. A partnership, sole proprietorship or corporation may choose not to cover its partners, sole proprietor or officers, though an officer who also does regular crew work is treated as an employee. In an LLC, as many as four people serving as members, managers or officers can be left off. The Insurance Commissioner's workers' comp office oversees the system.
Skipping it is expensive. A defaulted employer answers to injured employees for comp benefits and for common-law damages, and the Commissioner posts a default notice at your business (23-2-5). Whatever goes unpaid can follow you personally and attach to your property as a lien (23-2-5a).
Comp also sits inside licensing: the contractor affidavit swears you're registered with the comp fund. Even if owners elect out, GCs on mill-scale projects will want a certificate. Our workers' comp guide for electricians covers how it's rated.
The West Virginia electrical coverage stack
Start with what the license affidavit and wage bond law touch, then add what the big jobs demand.
Workers' comp
Registration is part of the license affidavit, and one regular employee triggers it. Workers' comp for electricians
Wage and license bonds
New and out-of-state shops may owe a payroll-sized wage bond before the first day. Electrical contractor license bonds
General liability
No statutory minimum we found, but every GC and owner checks it. General liability for electricians
Umbrella
Microgrid and mill contracts carry limits far beyond a primary GL policy. Umbrella insurance for electricians
West Virginia risks that drive electrical premiums
Three things set West Virginia apart for electrical shops right now: a new microgrid law, a payroll bond that grows with your crew, and mill-scale industrial work.
Data center microgrids
HB 2014, signed April 30, 2025 and effective July 11, 2025, created certified microgrid districts and a certified high-impact data center program. The Legislature found that some data center developers want microgrids for their primary and backup power. Private generation and medium-voltage distribution inside a microgrid is industrial-scale electrical work, with large umbrella and contract-liability demands.
A wage bond that grows with payroll
If you haven't worked a year in the state and aren't exempt, the bond equals four weeks of payroll plus 15%. Add journeymen and the bond grows with them, so new shops should price it before they staff up.
Heavy industrial construction
Nucor Steel West Virginia, at Apple Grove, is a $4 billion sheet mill on 1,700 acres with 3 million tons of capacity, built over three years with 2,000-plus craft professionals and 16 contractor partners. Mill-scale scopes bring high-voltage and arc-flash exposure, plus subcontract insurance terms far beyond residential work. See our commercial electrical contractor insurance.
Where we insure West Virginia electricians
We've verified electrical-specific details for three West Virginia markets so far. Each one leans on a different coverage.
Point Pleasant and Apple Grove (Mason County)
Nucor's $4 billion sheet mill sits on a 1,700-acre site at Apple Grove, just south of Point Pleasant on the Ohio River and about 45 minutes from Charleston. Nucor describes a three-year build across 16 contractor partners. Commercial electrical contractor insurance
Martinsburg (Eastern Panhandle)
70.1% of Martinsburg's occupied homes heat with electricity, against 46.1% statewide and 41.3% nationally (ACS 2020-2024). Winter-peak loads, heat-pump swaps and service upgrades are everyday work there. Residential electrician insurance
Wheeling
Wheeling is the opposite case: only 24.9% of occupied homes heat with electricity and 71.3% use utility gas. Heat-pump and EV charger jobs there often start in houses never sized for electric load, so the load calc and service change come first. General liability for electricians
How West Virginia electrical coverage is priced
West Virginia's license doesn't set a liability floor in statute, so your contracts set your limits. Mill and microgrid work pushes them up, along with additional insured and waiver wording. Residential service shops usually carry less.
Bonding is the West Virginia wild card. For shops without a year of in-state work, the wage bond is sized to payroll, so its cost scales with your crew. A surety will usually look at your company's finances before it writes one.
What you pay depends on your payroll and class codes, revenue, loss history, the type of electrical work you do and the limits you pick. Our electrical contractor insurance cost guide explains each one.
